The King (Charles III) (of Spain) confirms decree of Mar. 23, 1776 that consdent of parents must be obtained before matrimoney. The occasion is a lawsuit brought before the Real Audiencia of Mexico on Feb. 6, 1781 following hearings before the Alcalde Mayor of the city of Valladolid of Michocan (Mexico, in the present state of Morelia) by Don Josef Antonio de Peredo against Don Fernando Garcia de Quevedo for marrying his daughter Dona Mariana de Peredo without his consent. Document is incomplete.

Mr. Mann took him to see the House of Lords where he saw the King on the throne with a crown on his head. The Lords were dressed in their robes. The bill was read to the King and another man answered in French, ending with "Le Roi dit: The king consents." He saw the famous Lord North wha was shabbily dressed in five robes. The bishops were there. The Bishop of "Glouster" read prayers before the King came in. William thought he was in church but was told it was customary here to read prayers before business. Lord Boston was the best looking, and quite young. William followed the King into his robing room and saw him take off his crown. He saw the King again in his eight-horse coach in St. James Park. Four ladies and the duke of Cumberland were in the House of Lords. The Prince of Wales was not there. William is hurrying to finish the letter, as the post leaves only once a day at 11 o'clock. Persons guilty of crime who have taken refuge in sacred places are to be removed and placed in a safe prison whence after trial they are either to be punished or remanded to the ecclesiastical jurisdiction or freed. This procedure having succeeded in Europe is to be observed in the (Spanish) West Indies. This regulation is to prevent desecration of churches and further crimes by the accused who have taken refuge, as well as to speed justice. Cases in the Royal Audience of Guatemala, at Mexico (City) and Guadalajara have occasioned this decree. Thirteen articles regulating the transference of accused persons from the ecclesiastical to the secular jurisdiction are given. By order of the King (Charles III).

The district attorney of the ecclesiastical court at Havana answers a communication which (Cirilo) ordered to be made concerning legal actions which took place in regard to the sacred protection sought by Juan Antonio Jurado who fatally wounded Antonio Arzapalo. He reviews the history of the case stating that the governor of Louisiana, Bernardo de Galvez claimed the culprit for the secular jurisdiction in accordance with the royal orders of Oct. 7, 1775 and May 15, 1779. He gives the rules of procedure which are to be invariably followed in cases where a culprit seeks protection in a sacred enclosure which rules (Cirilo) must also follow.

The divorce was granted and the Marquis was condemned to return the dowry etc. When the question of dowry etc. came before the Council of the Indies it was decided that the ecclesiastical judges should investigate only the spiritual causes for divorce leaving temporal affairs to the magistrates. The said Paul has twice forged the signature of Father (John) Carroll and does not recite his treviary; he has also granted dispensations at St. Genevieve, (Missouri) for which he has no faculty. Valiniere's gentle reproaches have but ocassioned abuse from this Paul. Father Bernard admits that scandal will result from Paul's actions, yet he takes his side. Valiniere would be glad to help Father Louis (Guignes, O.M.CAP.) of St. Genevieve who sometimes needs help if Sedella approves. He (Valiniere) has always allowed Fathers Louis and Bernard to help in his territory. He encloses a letter which he wrote to Father Bernard.

Up till now he has been able to settle all his troubles through recourse to the Vicar General (Cirilo Sieni of Barcelona, tit. bp. of Tricall) and without troubling Hechavarria. Since his arrival in 1780, he has labored to the satisfaction of Bishop Cirilo of Barcelona who allowed him to choose as his field of labor the district of Opeluzas. But now, Father Francisco de Caldes has returned from Mexico and aims to make Opeluzas his residence claiming that (Hechavarria) has given him the faculty of choosing his place of residence. Great damage to souls will result from Caldes' presence at Opelousas. There is no reason why Caldes could not accept his former curacy. He humbly begs that (Hechavarria) will order that he (Arazena) remain unmolested in the care of the faithful now in his charge.

He has four Protestants under instruction and these intend to enter matrimony before Advent. In case he does not hear from Sedella before Advent he begs permission to marry them during Advent. The people here (at Mobile) say that it is the custom to publish the banns only once; Lamport asks instructions on this matter. In his last letter, he asked permission to celebrate Mass in Ohio in private homes as well as other privileges. He asks instructions in all these matters also. He has had slight attacks of the fever.

By a letter of Aug. 5, 1787, the King has decided that the nuns be incorporated in that monastery and now Hechavarria tells Sedella to see to the fulfillment of the royal decision and inform him of the results.

Fire began in New Orleans on Good Friday (Mar. 21) in the house of the Treasurer, Vincente (Jose) Nunes and soon destroyed the parish church and presbytery from which only the sacred vessels and a part of the archives were saved. Part of the parish books were sent to the house of the Manager of Tobacco (Renalto or Renaldo Brion) where the fire nevertheless destroyed them. He tells the extent of the loss. Some of the buildings were saved because a dozen or so men at Sedella's orders sprinkled their roofs. By this means the Royal Hospital and the soldiers quarters were saved. The governor (Estevan Miro) has taken effective measures which have greatly lessened the afflictions of the destitute. Andres Almonaster (y Roxas) has allowed Father Sedelia to use part of his house as a parish church since the Charity Hospital and the convent are far from the part of the city which remains. He asks (Hechavarria) to point out a place of shelter and thus spare him from the doubts which might arise.

Ramon de Posada y Soto, attorney general of the royal audience of Mexico reported on Oct. 1, 1783 the happenings in a case against several Indians accused of idolatry and asked for a royal command to all ecclesiastical judges to observe the law regarding seizing of the property of Indians in order to pay legal expenses, special fees and fines when they are leaving prison; also that dogmatist Indians or teachers of erroneous doctrines should be distributed among the religious convents there to be instructed in the Catholic religion and if they have property this should be left in the hands of their nearest relatives who must assist them while they are in prison. The fact that a perpetual prison has been established in Antequera of Oaxaca, (Mexico) to which according to Isidoro de Sarinana bishop of the place dogmatists are to be sent to and to which a house has been donated by (Father) Antonio de Grado, pastor of Vicayan does not alter this decree. Genevieve (Missouri) not only because of his indifference but also because of his hatred of religion and good order has attempted was against his own pastor (Louis Guignes, O.M.Cap.) and against himself (Valiniere). Peyroux also supports a certain Heyligenstein (Paul Heiligenstein, Father Paul of St. Peter, Discalced Carmelite) putative pastor of Kaos (Cahokia, Illinois), who has no testimonial of ordination and he also supports Gibeault (Father Pierre Gibault of Post Vincennes, (Indiana) who has publicly joined in rebellion. Peyroux has told the Americans that they need not be Catholics in order to settle in Spanish territory but only say that they are Catholics. Now (Sedella) and the governor of New Orleans (Estevan Miro) should see if such a man is worthy of his office. Further, Peyroux has slandered him (Valiniere). He awaits an answer. P.S. (John) Dodge is very friendly with Peyroux and he also says that Americans need not be Catholics to settle Spanish territory but only say that they are Catholics. However, Dodge is a robber and man of no religion.

Royal order.
The royal audience of Santa Fe (Argentina?) reported that in consequence of an appeal that two imprisoned concubines should be included in the royal pardon it developed that the crime of concubinage was of mixed statute and since the prosecution had been started it should be continued as those guilty of crime not included in the scope of the pardon cannot benefit by it. After consultation the royal will is that the rules for the prosecution for concubinage should be the same in the Indies as in Spain. Quotes from a letter of the bishop of Plasencia, (Spain) that: pastors should strive to uproot the public sins of laymen and if their efforts fail the secular authority should be invoked; fines imposed by pastors are not a sufficient restraint and that practice is to be condemned. If the local and colonial officials are negligent they are to be reported to the council of the Indies. When a royal pardon is granted it includes all those being prosecuted, provided their crime comes within the scope of the pardon. By order of the King, by Antonio Ventura de Taranco.

The epidemic which has raged especially during the last three months and which has resulted from the fire of Mar. 21 last and the overflow (of the river) has attracted the attention of the public and the evil odor coming from the cemetery has stirred his own zeal for the royal order of Apr. 3, 1787 concerning the construction of cemeteries. Fortunately, public opinion not being influenced this time by the prejudices usual in a matter of this kind, agrees that the cemetery be removed. The doctors unanimously agree that the public health will not be good until the cemetery is located as far as possible from the city. Therefore, the municipal council has decided that a new cemetery be started outside the city and behind the Charity Hospital. This is to serve as a provisional cemetery and the old is not to be destroyed till the reception of the royal approval. He has no doubt but that he (Sedella) will agree perfectly with all this, for the reasons given and above because of the above-mentioned royal order of which states that cemeteries are to be outside of towns. He expects an answer which will immediately start the work.

According to the enclosed letter of (Henri) Peyroux (de la Coudreniere) and the rumors abroad it would seem that the inhabitants of Ste. Genevieve are trying to petition the government and him (Sedella) to give them Father Paul of St. Peter, discalced Carmelite as their pastor. But those who know the place can easily imagine why the people want a stranger. Father Pierre Huet de (la Valiniere), so-called Grand Vicar, has had much trouble with Father Paul. He (Bernard) has also had some doubt about Father Paul's obedience and priesthood but though Father Valiniere has tried to force him to take sides against Father Paul he has reasoned that the latter's standing is good. Yet to secure rest of conscience he, in Nov. 1787, wrote secretly to his provincial at Liege (Belgium) that he might secure certain information from Cologne (Germany) where the Carmelite provincial resides. These letters having been destroyed in New Orleans he wrote again. He advises Father (Sedella) to suspend judgment in case Father Paul asks for the parish of Ste. Genevieve.

Valiniere to withdraw because of his scandals. Father la
Valiniere probably had wind of the coming of Father Le Dru as he
had already left, very likely taking the road to New Orleans. He
has told Father Le Dru that he could not administer the sacraments
especially Penance in Ste. Genevieve until he receives faculties
from (Sedella). Father Le Dru hopes that he will receive these
faculties since the people at Ste. Genevieve need spiritual help,
having been suddenly abandoned by the Recollect Father (
). The testimonials of Father Le Dru seem to be authentic and
his coming has given him (Bernard) much consolation but he would
like to see a Capuchin at Ste. Genevieve and another at St. Louis
to replace himself. He has told the Father Dominican not to be
disappointed if he is refused the faculties he asks. He
understands by (Sedella's) letter of January 20 last, the
difficulties to which missionaries who need his (Sedella's) help
are exposed by his silence, still he has for him all possible
respect.

In its stead is another law for the West Indies, Philippines, and the Windward Islands which states that royal judges should take care of this matter. The king now declares that such couples after obtaining the king's consent do not need that of their parents.
