This is a notebook 18mm. by 11mm. in which Richard jotted down various kinds of information, such as his mass intentions, scriptural references, recipes, weather occurrences, eclipses, choice book titles, etc. References are made to Baltimore and Kaskaskias. There are several slips of paper enclosed, one of which is a recipe for making ink with Walkden's fine British ink-powder (printed). Also there is this small note:

He speaks of Delouil (?) who has lost a daughter, Marie, whom Dilhet buried the previous day.

The points in question are the dowry of novices, and their knowledge of French and Spanish.

The convicts Jose Antonio Beltran and Fernando de la Trinidad Povedo, having killed an Indian in the settlement of Moculasa, of the Creek Nation called Enite, 30 miles from Pensacola, sought refuge in the church in that district from which they were taken on parole. After the trial it is apparent that the homicide was voluntary, premeditated and treacherous, as will be seen from the documents enclosed. Therefore they should not enjoy the privilege of immunity in accordance with the pontifical bulls mentioned in the enclosed documents. Carondelet thus asks the Vicar General to so declare and make the formal transfer of the prisoners to the military by the proper communication to the Pastor of Pensacola. The parole will then be cancelled and the judge will be free to pass sentence on the criminals and the criminals will receive their proper due according to the Royal Order of May 15, 1779.

These orders have been carried out and it was discovered that the two fathers owned the houses in which they had lived. Almonester y Roxas is to make arrangements with the lessees of these houses obtaining the aid of the governor and intendant (Francisco Luis Hector) Baron de Carondelet if necessary. Father Joachin de Portillo, present Capauchin superior is to be informed of these proceedings. Attested by Quinones.

Official letter. By the accompanying documents Henriquez will learn of the noisy differences between Father Bernard de Deva pastor at Attacapas and Captain Juan de la Villebeuvre commandant and civil and military judge of the same place. Because of this discord factions have sprung up among the inhabitants. A meeting was called at which Don Nicolas Forstall commandant at the neighboring post (______) was present and during which de Deva demanded powers and faculties supposing himself superior to the commandant and infringing on the royal prerogatives. Concord can best be restored by the removal of Father de Deva from the pastorate especially since his life little accords with his ministry as the enclosed documents will show. Therefore after consultation with Don Nicolas Maria Vidal his lieutenant and assessor general Carondelet has resolved to petition Henriquez to give De Deva another assignment; at the same time no doubt Villeveuvre will be removed from the office of commandant.

Petition: He says that he has been notified of his transfer from Attacapas to New Orleans. Ever since Charles III (of Spain) confided Louisiana to the care of the Capuchin of Castile, de Deva has done the best he could. Having appointed in (17)85 to Iverville, Louisiana he at the same time cared for the vacant parishes of Galveston and La Fourche as well as for Manchack (Manchac) and Baton Rouge, (all in Louisiana). The impossibility of attending all these places caused de Deva to represent the difficulty to Martin Navarro who was then general intendent of the colony. De Deva was removed to Attacapas where the labor was not less but he was aided by Alexander de Clouet lieutenant colonel and commandant at Attacapas. But de Clouet died at New Orleans and was succeeded by de la Villebeuvre. The Church was in a ruinous condition so de Deva appealed to Father Joachin de Portillo at that time vicar of the colony. Portillo notified Estevan Miro who was then governor of the province concerning the affairs at Attacapas. At this point the prosecution of de Deva began. The commandants of Opelousas (______) and of New Iberia (______) leagued themselves with Villebeuvre. Fearing violence to his person he fled from the post leaving Father (______) pastor at Opelousas in charge of the souls at Attacapas. On November 15, 1791 he arrived at New Orleans which place he has not left being detained by the governor (Miro) who wished to defer the matter till the arrival of his successor (Carondelet). De Deva asks to be informed of the charges against himself so that he may clear away all accusations and suspicions and be allowed to return to Spain.

Decree: When Father Xerez by the document cited above attempted to free the negress Maria Josefa and her child Maria Justa he violated the rules of his institute as well as canon and councilor decrees and the royal laws of this kingdom. Since, though appointed, Xerez never really held the position of chaplain in the army he could not use the indult granted by Pius VI on Feb. 10, 1784 at the request of Charles III, (king of Spain) and promulgated by the royal decree of May 3, 1784. Bishop (Felipe Joseph de Tres-Palacios of Havana, Cuba) made it clear to Father Joachin de Portillo, O.M.Cap., Henriquez' predecessor that Franciscans engaged in the active life ought not treat as their own what has been given them as alms. The bishop then added that account be made of the goods of Father Xerez so that they could be turned over to Father Isidoro de Fermosella, O.m.Cap., prefect of the mission. Therefore he declares that the deed of manumission of Maria Josefa and her child is of no value. Before Quinones, notary.

The second part of the letter grants the request of Miro that Irish pastors be appointed for people coming from rivers flowing into the Ohio. The removal is uncalled for because; he is assured of a cure for his leg; the King does not remove from service those who have not been absent over a month for sickness; he was able to visit Charity Hospital where the troops are being cared for until Father Francisco de Caldas, chaplain of the Royal Hospital took over his work, he has brought the sacraments to Antonio Cruzat, sub-lieutenant, to the cadet Vincent Borjes till his recovery as Ignacio Lovio will testify, as also to the first sergeant Juan Morales during his illness. Further, French must be preached in spite of the orders of the King, and the cases of Fathers Josef Maria Valdes and Simon de Fuentes prove that provisional chaplains cannot be removed anymore summarily than permanent chaplains.

Carondelet orders that in honor of their queen, the inhabitants illuminate their houses the nights of November 2, 3 and 4 and that a Mass be sung. (Ms. torn, it appears to read as follows) In reply Henriquez says that he knows that as soon as the first bishop of Havana is informed he would order the prompt fulfillment of the order. Henriquez hastens to fulfill it.

They have been commanded by Father Henriquez to go over the account rendered by Father Antonio de Sedella, O.M.Cap. on Jan. 18, 1790 to Cirilo (Sieni) of Barcelona, tit. bp. of Tricali of his time as mayordomo of the fabrique of the parish of St. Louis in New Orleans. Not finding all the records of collection for Father Sedella's time they had recourse to Father Diego de Carriedo, (O.M.Cap.), who allowed them to use the parish books but again they found part of record missing and so they were compelled to adjust by estimate the income of the fabrique for the years not covered by the record. They state the number of funerals both of whites and colored for the periods under discussion and follow this up by a list of the customary charges for a funeral. From this they computed the income from the funerals of the various classes, white and colored, free and slave, adults and children. They mention receipts from Juan Durel, mayordomo of the fabrique and Antonio Ramis. It is supposed that the pews from which most of the church revenue had come were destroyed in the fire of March 21, 1788. They mention payments made by Father Simon de Fuentes as well as others to Josef Martinez, Bartolome Bosch, (Jean) Aubry and the Ursulines. Although they know that there should have been more stipends during the period when Father Sedella was mayordomo (yet) as the settlement of these belongs to the collectorship not to the office of mayordomo they could draw up the general accounts only by means of the receipts which had been given to the collector. These receipts are missing so they could draw up no other account than that made by (Father Sedella).
