Father Ramon Ignacio Palao, a native of Barcelona in Catalan, arrived in this city in 1794 with a license from the Bishop of Havana where he was living and went to New Spain in 1798. He has asked for an extension of time and Penalver attests to the Metropolitan, to the Bishops and in particular to the Bishop of Puebla de L'Angeles and to the Cabildos and Vicars General that Palao at his departure from New Orleans was under no censure or interdict. It was public knowledge but Eufrosina was married to Mr. Loubi who was then overseas and who is now dead, as is Eufrosina. Gaillard asks (Penalver) to receive the testimony of the witnesses that there are no other impediments, that he is single, that he came to this city 14 or 15 years ago.

Thomas (Power) Pover handed over to (Penalver) one of Lonergan's letters written in Pittsburgh, undated, in which Lonergan wished to tell (Penalver) that he desired a parish in the Diocese of Louisiana. (Penalver) could not consider it if there were any damage to Bishop (John Carroll) of Baltimore, but since Pover added that Lonergan was about to leave the diocese, that he had asked for his dimission and that it was to be sent to him (Penalver) will admit him. (Penalver) sees that Lonergan was employed by Archbishop Antonio Cavallero y Gongora of Cordova whose memory is very laudable. (Penalver) is persuaded that Cavallero would never have made Lonergan synodal examiner without being sure of his talents nor would the Bishop of Baltimore have given him a parish unless convinced of his fitness.

(Carroll)'s last letter to (Penalver) was written more than a year ago and given to a captain sailing from Baltimore to (New Orleans). In it (Carroll) stated his anxiety to provide a priest for the Catholics at the mouth of the Mississippi and neighboring country, recently annexed to the United States of America out (of the territory) of the King of Spain. This letter is brought by Mr. Flechier, a Frenchman who fought under Louis XVI. He belongs to the family of Bishop (Esprit) Flechier of Nimes. All (Carroll)'s endeavors to provide for the faithful whom he mentioned have failed. The priest, after various delays, dared not undertake it and has transferred his efforts to another section. Therefore (Carroll) asks (Penalver) to furnish the churches nearest him in the diocese with priests. (Carroll) gives (Penalver) his powers and if he stations any priests in this work he may grant them the faculties customary in these parishes.

Lusson received (Penalver's) letter of last January 7. He sends the census of St. Charles and St. Ferdinand. St. Charles has a population of 709, an increase of 33; there are about 15 non-Catholic families. The marriages of non-Catholics are in a separate register for St. Charles, St. Ferdinand and St. Andre. All the non-Catholics come to St. Charles and St. Ferdinand to have their children baptized. St. Ferdinand has a population of 286; there are 50 non-Catholics. St. Andre, popularly called Riviere a Bonhomme has 6 Catholics and 50 or 60 non-Catholic families. The people of St. Ferdinand are working to build a church.

As (Penalver) will see from the enclosed copy of the letter, the governor answered that the same causes still exist. A copy of this is also enclosed in order to acquaint (Penalver) with all that has happened.

He asked for a license from the governor, who after the first banns, imposed the impediment of the obligation of the engagement and suspended the rest and so he would be obliged to fulfill the marriage. He begs that knowing Gonzales' freedom (Penalver) will commission the parish priest to perform the marriage.

The Intendant was convinced that the money which the nuns asked for should really belong to the royal funds since the little wooden houses built by Galvez no longer exist and the ground is occupied by those built by the king's royal patrimony which could bring a rental of 111 pesos a month, that it was wholly irregular for the governor to constitute himself administrator of this income. The king orders that he be informed through the undersigned secretary, Porcel.

On September 9, 1798, Penalver issued the following edict: One of his first obligations is to instruct in the duties of religion and raise his voice against public vices. (He addresses himself to the usurers and quotes the edict). What effect did this warning have? They have paid no attention to it. Men who claim to be Catholics have exacted these exorbitant interests and also women have engaged in this sordid business. Penalver warns that the guilty cannot hope for pardon without restitution. This decree is to be published tomorrow, Trinity Sunday, in the Cathedral and a copy posted. Father Isidro Quintero acts as secretary and adds that on May 31 the edict was published and posted.

A card written at Malaga June 10, `797, to Pedro Ferron of the Regiment of Mexico told that Josefa Blanco is dead and as he had no brothers and as there is a baptismal record of Jose Antonio Abad, born in Cadiz which mentions a son of Corail when he was adjutant of the regiment of Zamora(?), he believes that Abad, if living, or the immediate kin of the deceased would inherit the goods left intestate. This consists of money, jewelry, clothing, debts in his favor and the inheritance of most of the wealth of Captain Mig(ue)l Gutierres. (Gili?) is chaplain of the 2nd Mexican Battalion and he would like to induce those with a right to the legacy to appear and claim the fortune and leave something for Corail's soul. The heirs know no one here; the 2nd Battalion could be withdrawn any day and (Gili?) with them; it would be convenient to have the power given to an inhabitant. Antonio Ceulino(?), arsenal guard, Ant(oni)o Morales, treasurer of the custom-house, Juan Ventura Morales, auditor for the army, are from Malaga if the heirs wish to confide in them. His executor Jose Corail ordered 50 Masses for his soul. Jose Corail died at Nogales October 16, 1797 without a will; his goods are in the general depository. Lawyer Man(ue)l Serrano took charge of the inventory and auction because of the illness of the judge. Corail had not finished the execution of Gutierrez's will nor has Seranno since no one has advised him as they should as one-fourth of the Masses are his by parochial right. As Brady had had previous knowledge of which he told Penalver in a letter of the 6th, Brady felt obliged to give her safe-keeping at the home of Luis Badins. Brady also was informed that Father Luis (de Quintanilla, O.M.Cap.?) had married, baptized, heard confessions and given Communion without requiring anything and upon Father Luis' leaving the commandant made them pay. Such was the case of Luis Fran(cis)co who paid 26 pesos. Domingo Boligni having to leave in 2 or 3 days for the capital, Brady sends the proceedings from the D'Anemour complaint.

On the part of D'Anemours, Jean Louis Alexandre Breard and Louis Michel J(ea)n F(ran)cois Lamy and on the part of Lucille White, Etienne Repone and Michel LeVillain, voluntarily acknowledged that they had made an agreement about the marriage, as follows: Mr. and Mrs. Repon had promised to give Lucille in marriage to D'Anemours before the Commandant, for lack of a priest, the ceremony to be renewed in the Church as soon as the opportunity arose. Filhiol has communicated the mandate of April 12 from Brady separating him from the young person he married March 22. In 1782
D'Anemours sought to marry Miss Racourt (Julia Rocourt). He could not marry without permission from the king; seven or eight months must elapse before he might receive it. He proposed that they pretend a private ceremony had united them, promising to write immediately to France. After six months (Rocourt) went to the West Indies and then to Paris. After seven years she returned to Baltimore and proposed that he retake her. He rejected her and she sailed for the Cape in Hispaniola. The death of Lewis XVI brought D'Anemours' displacement. He became an American citizen. Miss Racourt, who retained the name of D'Anemours, not being able to prove any religious ceremony, gave up the suit, and in March, 1796 married a Mr. Nau from the West Indies. Dr. Luis Giovellina testified that at the end of 1783 he arrived in Baltimore as a surgeon on a French frigate to pick up men from the French army who had served under Count de Rochambo. Giovellina saw much of Denamour. His wife was having quarrels with him. The origin of these quarrels were discussed frequently by Madame D'enamour with Mr. Goys to whom D'enamour objected. In May 1784 she went to Burdeos and then to Paris to confer with her mother. Giovellina met her and her mother in the Ministry of War office and an official, Mr. de San Pablo, asked if he knew her. He answered yes and San Pablo said that she never talked of not being his wife. This was at the end of 1784. When Giovellina was in Nantes he learned that she was there but he did not see her. She had no right to ask for his salary in the Ministry of War office; she would have had to have her marriage license. Giovellina signs as Louis Giovellina.

Also 1000 pesos for Masses for the souls of his parents, naming as executors Alon and Molas, and as heirs, his brothers and sister, Fran(cis)co, Manuel and Getrudis Falladas, and his nieces and nephews. Alom appeared and swore that Falladas died in the province, leaving the city, ill, in a pirogue for up the river, that he could not give the exact day nor the parish but that when he received notice of his death, Alom had had a Mass said and this would be found in the book of fees on July 16, 1790. He did not draw up papers because when Falladas left he told Alom, if he died, to see the grocery store and add it to the money which made a total of 2500 pesos. Those who went up with him in the pirogue told of his death. Alom knew them by sight but now after more than 10 years he could not remember them. Alom turned the 2500 pesos over to Mariano Ton to be sent to Jose Pruna(?) y Culler. Alom lost Pruna's reply upon receiving the will but he had no receipt for the money. Ton had not written and Alom does not know if he turned the money over to Cullere but he is convinced that he carried out the will. Ton arrived here by boat from Cadiz but Alom does not know if he reached Cataluna. When Ton received the money he wrote that he explained to a brother here named Ramon (Font) that he had received it. Molas left this city more than 5 years ago and one of his sons said he had died since. Molas concurred in the sale of Falladas' assets but Alom has no documents of this except that they called in two appraisers who verbally gave a value to the goods of the grocery store. Although Alom knew one he could not remember who it was. Alom is 44.

The lack of information about Falladas' death and lack of inventories indicate a malicious obscurity. The legal bequests, the three Masses, the paper of the 27th and that of January 17, 1792, in which Mariano Ton received from Benito 2500 pesos to be turned over in Arenas to Jose Pruna y Cuellar is another cloud as confusing as the first. The pious works do not seem to have been fulfilled nor the heirs to have their share. This last concerns the Royal Judge, the first (Penalver). It seems to Valdes that the pastor of the Cathedral should certify whether he buried Falladas and if necessary the same should be done in other parishes with any news they can ascertain about his death. The notary Pedesclaux should certify also and the aid of the Royal Judge is enlisted.

Three Masses are to be said for his soul. 2 reales are to be given for each legal bequest. He is single. In the church of Arenas del Mar, an anniversary Mass is to be said every week. If the amount necessary for this does not reach 1000 pesos the amount left over shall be equally divided between the Capuchin Convent and the parish named. He gives to the same parish of Santa Maria an equal amount of 1000 pesos for the souls of his father and mother. If there are any debts, his executor is to pay them. His executors are to collect various debts for him. He has about 2,200 pesos in money and several small businesses with a store situated opposite the levee beside the New Exchange(?) and a house in Arena del Mar in Cataluna. To the negress, Maria Francisca, slave of Juan Bautista Mersier he gives 250 pesos for many services; 50 of this to be used as she wishes, the 200 to be given to someone she trusts so that together with the interest she may purchase her freedom. He names as executors Alom and Molas to whom he extends the time of one year or longer. He names as heirs his brothers and sister, Francisco, Manuel and Tertrudis Falladas and all his nieces and nephews in equal parts. Valdes has examined the testimony in Falladas' will and (Sedella's) certification. The date, parish and ones who saw him die are not known and yet Alon took over his property, sold it, and disposed of the proceeds. Valdes thinks a circular order should be sent to the pastors of St. Charles, St. John, Santiago, Valenzuela and Iberville which are those on the river, and to those adjoining for certifying whether from June 28, 1790 to July 16, 1801 Falladas had died in their district or whether there were any entries in their books or knowledge of him. Alon should be ready to prove whether Mariano Font, who it seems signed the receipt on January 11, 1792 that he had collected 2500 pesos to deliver in Arenas del Mar to Pruna Culler, really did so, if Culler did so with 1000 pesos to be given to the acting pastor of the parish of St. Mary of Arenas to fulfill the memento of Masses, and another 1000 for Masses for the souls of his parents, all with certified documents. Since this executor by his informal proceedings and negligence has created suspicion, for safeguard of the pious works, a mortgage should be placed on his goods at St. Bernard of New Galvez. An order should be given to the commandant so that the aid of the governor may be asked until Alon proves himself.

Without doubt there is nothing of greater interest than the payment of interest and the retirement of the royal bonds issued for the defense of the monarchy. His Majesty has decided to apply certain excise taxes to this end, among them an augmenting by one fifth of the alms of the Bulls of the Holy Crusade for the Living and Dead and by half of those of Illustrious, Composition and Milk Foods. De Bustos is in charge for the term of 1802 and 1803. He believes the best way would be to distribute circulars to the pastors and assistants in order to announce this to the faithful. to avoid the heavy cost of sending copies of this edict, the printing is to be done in the bishoprics. (Penalver) is also to exhort the pastors and assistants to carry out the royal intentions. P.S. Since there is no Commissioner of the Crusades in the diocese (Penalver) is to commission the Prebendary of the Cabildo to appoint one who together with the royal treasurer will proceed to execute what is assigned to him by the enclosed circular to all the commissioners of the Crusades.

Last week Vallejo received Penalver's letter of July 2 in which he sent a copy of the letter of October 8, (17)99 ordering Vallejo to advise Father Buena Ventura de Castro, (O.M.Cap.), to return to the capital where he would be received with kindness. Vallejo assures Penalver that he has never received the above letter nor has Governor Juan Bap(tis)ta Elquezabal. When de Castro arrived at Nacogdoches Vallejo was the priest at that place. He tried to persuade de Castro to return as soon as possible but de Castro assured him that grave causes had made him withdraw and that he had written one or two letters to Penalver asking for the passport to Havana and when he moved to these missions he wrote to the Provincial of the two Castilles (?) who lives in Madrid, Father Fidel de la Calzada and it seems that the provincial replied that he could remain in these missions until something else came up. But up to the present it does not seem possible to convince de Castro and he keeps saying that Louisiana does not suit his spirit.

On November 19, 1799, there was sent to Nicolas Maria Vidal, acting governor, a letter like this: Having examined the accounts of the Charity Hospital for the three months from October 1, 1798 to the end of the year as drawn up by the administrator, Fran(cis)co de Leiva, (Penalver) found it without defect and returns it to Vidal to conclude. With the alms ordered to be collected and Vidal's gifts, the hospital has been decorated, the numerous sick in the epidemic of August, September and October were cared for. In order to continue more funds are necessary. The coffin department which was taken away by Manuel Gayoso (de Lemos), Vidal's predecessor might be of help. The hospital has begun to make them again at the former prices and it would be desirable to let the hospital have this exclusive privilege as laid down by Baron (Francisco Luis Hector) Carondelet, predecessor of Gayoso. Two tracts of land owned by the hospital could be very useful but there are no funds; (Penalver) is persuaded that there were funds belonging to the hospital in the possession of Andres de Almonaster, its patron, at the time of his sudden death April 25, 1798 but they must be straightened out and collected. Almonaster was exempt from rendering accounts by the royal edict of August 14, 1794 but this privilege did not include not keeping accounts. He left the current accounts of the hospital up to March 31, 1798 signed and approved as can be seen from the books of the administration in charge of Leiva. There must have been another which he did not have time to approve. The last accounts of Leiva, presented by Gilberto Leonard obliges (Penalver) to draw up the instructive file which he encloses; Father Juan de Dios Valdes annotated the first and revised the others and (Penalver) concludes from his paper of the 16th that 4323 pesos 3 reales was realized by Almonaster during the administrations of Leonard and Leiva of which (Penalver) has no account. The revenue from twelve ports, the rent from taverns, smaller revenues, the legacy of Father (Francisco) Caldes, (O.M.Cap.), the medical care of the patron's slaves are sums of which there is no account; presumably he kept a private account in order to return them to the hospital. It might be explained to the widow who is the executrix so that his papers might be examined for any notes; if not, to show her the notations of the auditor and make up her mind that in justice the sum should be returned. (Penalver) does not speak of the 300 pesos of the legacy of Fran(cis)co Munoz as it has not been proved that Almonaster took it not that it was for the hospital except that a lamp was to be lighted in honor of Our Lady of which he will treat separately. In February (Penalver) asked for the file of which he spoke and which Vidal returned to him; it is the same one which he enclosed to Salcedo for examination. Although the hospital, according to Leiva's settlement, took 2021 pesos 3 reales more than it repaid to the patron, this should not be deducted. Perhaps the patron thought he would repay services received from the hospital with these expenses. Therefore the shortage is 6344 pesos 30 reales. Since the letter of November 19 up to today the activities of the hospital have increased. This requires more receipts. If there are any difficulties with the widow they should be referred to His Majesty in his royal and supreme council. (Penalver) has postponed this in order not to interfere with Leiva's settlement; now that it is completed, he believes he should not defer it.

In virtue of his nomination to Guatemala, Penalver must go to take possession of that see. He wishes to leave a satisfactory ruler for the diocese to govern it until the bulls freeing him from it are dispatched and notice is given, according to the royal cedula of November 6, 1786, in which event since it has no chapter, the government reverts to the metropolitan or in default to the nearest suffragan, and in case two are equi-distant, to the older one according to the cedula of November 13, 1799. He appoints Father T(h)omas Hassett, older canon as ruler of the diocese. He will be under Penalver's orders as long as he is here and afterwards will rule by himself until the event above stated. Penalver exhorts the members of the diocese to regard Hassett as ruler until another is appointed by competent authority. Father Isidro Quintero acts as secretary.

In 1797 by order of the king there began in Madrid the publication of a periodical "Semanario de Agricultura y Artes," the prospectus of which is enclosed, to spread the knowledge of rural economy and industry. To extend the circulation of this magazine His Majesty recommended that the bishops make it known through the pastors to whom it is directed, urging them to spend as much time as their ministry allows in furthering the temporal welfare of their parishioners. But having learned that few copies of this work have circulated, His Majesty wishes to remind the bishops of the previous order on this point sent out by the Minister of State that the pastors may pay for this out of the account of the church.

It is impossible to continue as she has three daughters who daily are exposed to hearing the words her husband uses when drunk, all of which is very harmful for their edification and chances for marriage.

It can be seen by the opinion of the assessor, Manuel Serrano, in which (Penalver) concurred, that in the verdict which was sent Duralde the omission of the documents giving him ownership of the land which Father Pedro Zamora, (O.M.Cap.), damaged contributed to his condemnation. It seems to Duralde that it would not be against justice to have had the attached memo accompanied by the copy of the bill of sale and the certificate of inventory upon which his rights rest. He takes the liberty of returning all the documents, asking that his case be reexamined in the light of these new documents. Since both are signed by him and therefore may be considered illegal, he has asked Carlos Trudeau to show (Penalver) a copy of the bill of sale made by Nicolas Forstall. It will always be a scandal to him that Zamora, a Capuchin and pastor, knowing that the land was Duralde's and having other lands more convenient, should have been the one to open the door to an abuse which would have fatal consequences among the inhabitants.

Illness and the difficult work of his office have prevented him until now from answering (Penalver's) letter of September 30 enclosing the proceedings to better the assistance to the ill and a copy of the paper which was sent with the letter of November 19, 1799, to Nicolas Maria Vidal, governor and vice-patron concerning the Charity Hospital, the doubt that Penalver has that there would be funds in the treasury for building on the Hospital's land, accounts which the deceased Andres Almonaster was to bear, whereabouts of the rentals from the twelve gates, tavern rentals collected in the administration of Fran(cis)co Leyva, the legacy of Father Fran(cis)co de Caldes, (O.M.Cap.), and the treatment of the patron's negroes. Salcedo is pleased with the ability and foresight with which Penalver proposes that the widow solve the affairs with the papers which have been left or if there are difficulties, have recourse to His Majesty through his council where they will be solved. Salcedo would be glad to have the governor conclude this delicate and thorny affair but since he has not done so he will take the measures he believes will carry out Penalver's wise and zealous foresight. Salcedo will be happy if he can follow Penalver's zeal in explaining the affair to the widow. (Penalver adds a note on the first page: To be turned over) to the vicar-general of the diocese.

Gili, chaplain of the 2nd Battalion of the Mexican Infantry tells (Penalver) that in the treasury of this battalion there are various sums deposited by members who have died intestate. Article 4 of the royal order of July 20, 1779 orders the chaplain to celebrate the Masses agreed upon or at least one-fourth of them. Gili has also been informed by Fran(cis)co Pasqual, Judge Advocate, that on pagve 308 of the same book it is stated that if the balance of the intestate soldier is 100 reales or more it must be invested for the benefit of his soul. The first is a law, the second a very pious suggestion but as this commandant does not venture to turn it over and the souls of the dead lack suffrage, Gili begs (Penalver) to send him a letter with his backing so that it may be determined what is just.

In his letter of November 11 Juan Bautista de Elquezabal, the governor of Texas, told Garate: "Father Buenaventura de Castro, O.M.Cap., who came from Louisiana to this province and now resides here, asked permission of its prelates to go to the convent of Havana whose prefect and president of the missions of that colony sent a patent in his favor to the governor of that island. this official transferred it to the Viceroy of Mexico and that official to the Commandant General of these provinces who in an order of September 15(?) gave it to Elquezabal asking him to deliver it to de Castro and make the necessary clearance. This is in answer to Garate's letter of October 12." Garate sends it on to (Penalver) for his information concerning what he told him in his letter of October 12 in answer to (Penalver)'s letter of July 2.
