Bishop Luis Penalver y Cardenas on October 31, 1801, sent to Carlos Howard, Lieutenant Colonel and Commander of the Regiment, a letter (referring to) Howard's letter of May 13, 1801 in which Howard (reported on) the balances of the deceased of the First and Second Battalions. Verbally Howard told Penalver that he had an order from Colonel Pedro Piernas that not more than 25 pesos from those who die intestate be turned over for suffrages for their souls. Penalver wishes to settle this before he goes as his conscience is disturbed about this delay in having the Masses said. In a letter of November 5, 1801, (the entire letter is quoted). Howard answered that he found out from Captains Luis Desalles and Ignacio Delino, trustees for 1800 about the funds belonging to deceased soldiers and found a balance for both battalions of about 50 pesos or more up to the end of 1799. (The procedure) ordered by Piernas on September 16, 1790 (is given). Howard is ready to execute Piernas' order provided it is approved by Salcedo. On the other hand he does not believe he is authorized to do so, so that it will be of importance that Penalver write to this official. However, he reminds Penalver that the scarcity of funds would not allow him to give the suggested amount of 50 or more pesos. Howard would like Penalver to signify the morning which would be convenient for all the clergy who are interested to come. Hassett sends this to Salcedo to hasten his approval in the matter.

Barriere received (Penalver)'s letter of August 22 on October 20. As soon as the waters permit he will go down to the city and satisfy (Penalver) on the matter of confession. It is true that he has a woman to keep his house. But he would not have taken her if she had not been of a competent age. There is no ruling in this diocese but Barriere's diocese of Bordeaux rules that pastors take housekeepers only over 40 years of age. His servant is fifty as can be seen from the baptismal register of St. Francis Xavier of Ouabach for 1786: On December 21, 1753, was baptized Anne Perron, born December 20 to Pierre Perron and Marie Francoise Dufournel; the godparents being Antoine Guilbert son of Toussaints Guilbert and Anne du Devoir, signed by Father ( ) Vivier, S.J.. Barriere, as pastor of St. Martin's of Atakapas, affirms on October 24, 1800, that this is a true copy. If a woman of this age is not competent, it would have to be a negress or a mulatto of 25 or 30 who would always be doing everything possible to get her master to buy her liberty by her sacrifices and who would undoubtedly have children. It would take a thousand pesos to buy a slave. He has only one slave.

The reason he had not been to Confession was because he had no confidence in the two priests cited in the letters. He overcame this difficulty by confessing many times since then to Father (Alexander) Viel. Barriere was warned to say nothing of what had been discussed.

Penalver, Archbishop-elect of Guatemala, must go to occupy that see leaving in Louisiana someone satisfactory to take his place until the bulls are dispatched freeing him from it and the corresponding notice is given as stated in the royal decree of November 6, 1786. Since there is no chapter the governing reverts to the Metropolitan or in default to the nearest suffragan, or having equidistant ones, to the oldest according to the decree of June 13, 1799. His departure being near, and having confidence in the good qualities of his vicar-general, Father Thomas Hasset(t), senior canon, Penalver appoints Hassett as ruler of this diocese, under Penalver's orders while he remains and afterwards by himself until the event, above stated. Hassett may use any faculties Penalver possessed and can give him and also those delegated according to the bull by Pius VI in St. Mary Major on September 11, 1789. Penalver exhorts all his diocesans to take Hassett as the governor of the bishopric. father Isidro Quintero signs as the secretary.

He asks the king to appoint two canons with the title of assistants to the bishop so that they could act in his absence, sickness or death. He names Hasset as one canon as much because of his good life which Penalver has known for 14 years as for his services as pastor and foreign vicar in St. Augustine, Florida for many years. Penalver has the royal decree from Madrid, August 4, 1790 stating that if it concerns America, it is to be referred to the viceroys or presidents but as this province is not dependent on the Indies, Penalver applies directly and proposed Hasset as vicar-general since they have no ecclesiastical chapter ... On April 21, Xerez, former assistant at New Orleans and vicar of the Ursulines, was given a copy of the letter from the auxiliary bishop of Havana, to which he replied on May 7 enclosing an account of the disposal of his furniture and clothing when getting ready to leave for Havana, giving the value of each item which in all amounted to 821 pesos, but he did not send one for the tax office. The auxiliary bishop replied that all proceeds would be sent to the Capuchin College in Havana. Rivas certifies on February 4, 1796 that this is a true copy of the royal decree.

Xerez, Ex-Grand Vicar of the Province of Castile and Missionary Apostolic, formerly of the College of Havana, states that he was informed of the king's decree by the secretary, Ant(oni)o Ventura de Taranco, to explain the letter sent on by (Sieni). His Majesty recognized Xerez's innocence; he did not deserve the decrees against him. Xerez presents the attached (list) of what he had in his house. The first item of 112 pesos, 2 reales of a receipt of Father Ignacio de Olot did not bring one maravedi. What (Sieni) said Xerez gave to his slave, no one can say; Xerez asks His Majesty to order her freedom to be given to her. Ignacio Sebastian de la Parra, in Madrid on September 17, 1795 certifies that this conforms to the original in the Secretariat of New Spain. Rivas certifies it also on February 4, 1796.

Complying with the order from Bishop Felipe Jose de Trespalacios, of which Father Joaquin de Portillo informed him, Cirilo sends what he knows pertaining to Xerez. It was at night, so says Xerez in his letter to the auditor, Jose de Orue, written on board the Borsa, and which is No. 27, that Cirilo, accompanied by Father Fran(cis)co de Caldes and Olot and the adjutant (went to Xerez's house). Xerez asked permission to take the money he had in his cabinet. His slave began to cry and Xerez gave her all her clothing and asked Cirilo to give her her freedom. Keeping slaves in the house for domestic service goes back to Father (Antonio de) Sedella who established it in Cirilo's absence. Fran(cis)co Ortega said Sedella's slave lived as if free. Another day on going to Xerez's house they found a box with a note for Ignacio Dominguez which was sent with the papers as No. 29. Cirilo also went to the house where they had picnics, represented as a cabin; it and Sedella's are the only ones that could be called houses on the island; he has heard that it cost more than 1500 pesos. How did he get all this money, since in the 5 years he was there, his salary was only 30 (pesos?) a month. Some accused him of business dealings; some said money was being taken from the collections. Basilio Ximenez declared that the truth was being confused. With the exception of the testimony of Sergeant Felipe Trevino and Lieutenant Fran(cis)co Duberge in the Sedella case, no doubt is left that the auditor favored the above monks. If an opinion is wanted about the auditor in public, with the two chiefs of his firm Andres Almonaster (y Roxas) and Jose Ortega, one can go from house to house, whose inhabitants would slay that they would like to see them leave the city, that all who dealt with them were suspect by the public. Sedella used the title of Commissioner of the Holy Office to evade the certificate sent to Spain, the only reason Governor Estevan Miro had to carry it out. (Sieni) has the letter sending the friar back to Havana. The list sent to the bishop was false; (Sieni) includes the papers of Father Fran(cis)co(!) de Deva. (Details are given here of testimony involving) Mr. Botet, a sacristan, José Modena and Manuela Palacios. Included besides the money and goods (itemized here) and a letter of (Sieni)'s and the reply of Mr. del Más, was a slave named Babis, 26 years old and her four children, Onorio, Antonio, Theresa, and Celestina. This is a copy of the original enclosed in the testimony sent by the Bishop of Havana in a letter of July 19, 1794. De la Parra certifies that this is a true copy of the original in the Secretariat of New Spain, Madrid, September 17, 1794. Rivas certifies it is a copy of Cirilo's letter sent with the royal cedula of September 27, of which a copy was ordered made on February 4, 1796 in New Orleans. Rivas notes that what was said in yesterday's decree about Xerez' goods does not appear in the inventory book of the Archives.

A report of the merits and literary employments of Enrriquez, priest of the diocese of Havana, attorney of the Royal Audiences of Mexico and Santo Domingo and ecclesiastical judge appointed to go to Louisiana. He is a native of Havana; son of Teodoro Enrriquez Mori and Juana Fernandez Bello, grandson on the paternal side of Juan Enrriquez Mori and Ana Severina de Ogeda and on the maternal side of Juan Fernandes Bello and M(ari)a Fran(cis)ca Marrero, prominent families of Ostend in Flanders and of Laguna, the Island of Tenerife. In 1746 he began his clerical studies receiving the tonsure from Bishop Juan Lazo de la Vega. In 1758 he graduated as Bachelor of Canon Law and Theology. (Other degrees and capacities are listed, including those) at St. Charles Seminary together with his qualities as a priest, as attested by the rector, Father Francisco de Santa Maria Sanchez. Bishop Santiago José de Echevarria appointed him as a synodal judge, as visitator and advisor. Then he appointed him Vicar Ecclesiastical Judge of the five auxiliary places outside Havana. Penalver testified to his exemplary conduct in this office. Mig(ue)l Penalver y Calva of Havana in 1771 appointed him his advisor and he also executed various projects given him by different governors. He had a dam built in one place, assuring a sufficient supply of water. Juan Mig(ue)l de Castro Palomino certified that the present Bishop Trespalacios would continue him as Ecclesiastical Judge of the five outside districts. The aforementioned prelate appointed him his Vicar General on November 13, 1790. This same Bishop appointed him Vicar-Forane and Ecclesiastical Judge of Louisiana on November 29 of last year where he was to go to work publicly and secretly investigating the conduct of Portillo, to whom on November 17, 1790 he had given the same duty, and the other ecclesiastics there and give a report to the Secretariat of the Indes like the one for New Spain of November 20, 1789.

Salcedo gave Hasset's letter of the first to the Intendant, who replied: "The assessor, carrying out his decree of the first consulted him on the second as follows: Besides being a just petition canon and civil laws demand that parishes have cemeteries corresponding to the population. He agrees that in the case under discussion the ownership of the plot is exactly as stated so that Salcedo could give his consent if he wished. Therefore, the intendant sees no difficulty in Salcedo's ordering the surveyor to stake out the extension and in carrying out the promise of the Baron (Francisco Luis Hector) de Carondelet about the construction of the paved highway leading to this place, leaving for later the supplying of the title and the profit." Salcedo sends this copy to Hasset in answer to his letter, returning the original of the majordomo. Salcedo is ready to grant this petition as quickly as possible. In a letter of July 3 the Acting Commandant Francisco Collell wrote as follows: "In answer to Salcedo's letter of yesterday and those enclosed from Hassett and Father Isidro Antonio Escalera, Provincial of the Order of Our Lady of Mercy in Mexico, relative to Garcia, a fugitive from that order, serving in Collell's regiment under the name of Urrieta, Collell states that Urrieta enlisted July 16, 1801, at the Castle of St. John in Ulna and took a provisional enlistment since the adjutant Juan Sargran had not sent the original. This was received on October 6. He is known as the son of Josef and Mariana Garcia of Monterey, his trade a barber, single, 5 feet, 32 years old, black hair, his conduct of the best. If Salcedo thinks the documents are sufficient to dismiss him, Collell is ready to do so. At the end of December 1801 he owed 300 reales." Salcedo tells Hassett of the debt so that Hassett may tell him what he thinks. Salcedo is ready to give him permission.

Last Sunday O'Connor went to see him and sent for Dr. Flower. It is uncertain when Lonergan can proceed. All were so pleased with his doctrine that O'Connor is of the opinion that a few sermons more would convert most of the old people. O'Connor requests that Hassett will consider if he can employ him better than there. The bearer, Robert Sproul, goes to New Orleans to establish himself in business there. Hassett's friendship, together with that of their mutual friend, Father (Patricio Walsh), would be esteemed exceedingly.

In succession Gutierrez, 56 and Rodriguez, 23, give their testimony which was turned over to Tomas de Rameri, Commander. The purser Jose Benedito was unable to supply the family relationship of Amado. Amado stated that he was the son of Antonio Amado and Maria del Rio. Rameri sent Pedro Morales and Juan Antonio Gomez to examine the place where Juan Felipe was wounded. Amado was summoned to explain his quarrel in the mess-hall with Juan Felipe. Gutierrez testified again adding that Helmsman Manuel de Lago had been with Gutierrez washing their clothes. Rodriguez, Morales, 31 and Gomez, 34, testified. The following witnesses then testified: Diego Macaboy, 20; Boni, 52, Espinosa, 36; Fran(cis)co Sanchez, 22. Learning that Juan Felipe came from Castilla de San Miguel, Boisgrollier asks Ramery to write to the governor there to inquire about him. Vicente Folch answers that he found nothing there about Cespedes. Second Lieutenant Martin de Uria stated he had found Juan Felipe dead. Adjutant (Jose) Alpanseque and Lopez found a knife on the ground. They informed the doctor who examined the body. Lopez gave his testimony about finding the body as did Fran(cis)co Almazan. Alpansegue, 35, Dr. Juan Rubi, 79, of the Royal Hospital of Pensacola and Diego de Barrios, 40, senior intern, gave their testimony. Rodriguez and Gutierrez testified again. Francisco Xavier Pardo was named as counsel for the defense. Amado made his confession. His church paper was signed by Father Santiago Colman, pastor of St. Michael's of Pensacola. The testimony of Rodriguez, Gutierrez, Boni, Espinosa, Calbino, Ibanez, de Castro, de Lago, Tamargo, Sanchez, Lopez, Almagan, Alpansegue is ratified and compared. Amado's jacket was identified by the tailors, Jose Perez and Jose Mariano Arellano.

Bulnes, by order of Lorenzo de la Puente, Commander of the ship, went to the Hospital of Our Lady of Carmel to take Rodriguez's testimony. Rodriguez declared he had been wounded with a knife by Tinoco over three pesos. Tinoco declared that he did not know the name of the man he injured as everyone called him Dad. Tinoco fled to the church where he stayed until the pastor gave him the church paper. Tinoco is 50. Tomas Ramery, Commander of the Naval forces at Pensacola, ordered a recorder appointed and Buytrago accepted. Tinoco is the son of Nicolas Tinoco, a native of Mexico, according to the records of Martin Covian. Bulnes and Buytrago took Rodriguez's formal declaration. Rodriguez is a native of Cumana in America. Rodriguez and Tinoco met Jose (Ignacio) Garcia, another cabin boy but Garcia left. After Rodriguez was wounded he went to the hospital attended by Dr. Juan Ruby, who gave his testimony. Ruby is from the Royal Hospital but assisted with Rodriguez's care. Ruby is 50. Tinoco was brought to testify again. Fran(cis)co Pardo had been a witness to a previous quarrel over the money. Tinoco was taken to the hospital to compare the testimony. Rodriguez died and bulnes and Buytrago identify the body. Ruby being ill, Dr. Diego Barrios certified, along with the ship's doctor, Miguel Barrera. Fran(cis)co Navarro and Agustin Rebelles also identified the body. Garcia then gave his testimony. He stated that in a quarrel Pedro (Boisgrollier) Burgrolier had parted Rodriguez and Tinoco. Garcia is 35, a native of Puebla de los Ang(eles). Pardo gave his testimony. Bourgrolier, Second Lieutenant of the Royal Armada, gave his testimony. Covian, the purser, gave his testimony. Covian is 28. Martin Uria y Novea of the Frigate Sirena was appointed to serve as counsel for the defense. The prisoner's confession was recorded. The testimonials of Garcia, Pardo, Bourgrolier, and Covian were ratified. A copy of the church paper signed by Father Santiago Colman, pastor of St. Michael's was put into the proceedings. The four testimonies were then compared. The proceedings were to be turned over to Ramery, commander of the Sirena.

He was promoted to 2nd Corporal on October 1, 1796 from which date he is to serve 6 years. Signed by Jacinto Guiral. Pedro Rodriguez gave his testimony. Morales thinks it is necessary if the Church is to get all use possible out of the ground to add a room to each so they could be rented with much profit. It is necessary to cover with tile or brick the shed made of pickets behind the church if furniture is to be kept there. This expense would not be great as it would only be necessary to put a roof over what is there.

Father Antonio de Sedella, pastor, yesterday wrote Morales as follows: "The cemetery is almost filled. As majordomo Morales will have to inform the vice-general of the necessity of an extension, citing the fulfillment of Baron de Carondelet's promise to raise it two feet and to build a walk leading to it as otherwise it is impassible in wet weather. Sedella calls this to Morales' attention so that in this way they may avoid the infection that would result from burying bodies on top of one another." Morales notifies Hasset so that if he finds it convenient he may ask the governor for up to 600 feet on each front including what is now the cemetery since the old one comprised 600 feet and the population was not one third of what it is now. Morales is aware that the ground is under litigation but the governor could make an agreement with the Judges of Appraisals and have the surveyor stake out the plot, reserving the right to confer the title when it is determined. Former Governor Carondelet's letter is in the secretariat in which he offered to raise the ground and build a walk from St. Ferdinand gate to the cemetery. Up to now neither has been done. (Hassett adds a note that he answered on June 18).

As head of this family Fulton asks (Hassett) to impose on them canonical penances prescribed since all three are now in the district of New Feliciana, if they have not yet returned to El Rapido.

In his letter of yesterday Salcedo transcribed what the Chaplain General in a letter of October 8 has said about Father Estevan de Valoria, O.M.Cap., Prefect of the Capuchin College in Havana requesting that since Father Tyrso de Peleagonzalo, (O.M.Cap.) had been appointed vicar of that college, Salcedo arranged for his return to Havana immediately and that Salcedo hoped that Hassett would assist him in carrying out this arrangement. In answer Hassett must explain that he believes that if the Chaplain General was informed of the lessening of the number of the few priests in the Province by the departure of this religious who serves an extensive parish of all Spanish and whom it would be impossible to replace, he would not insist on taking him from his poor flock to restore him to a college composed of three or four individuals and situated in a city well provided with priests. It seems to Hassett that Salcedo could stay the execution of this order until he hears from the chaplain general. If, however, Salcedo wishes to carry it out, Hassett gives his assent.

This letter is to serve as an order for Ubaldo to appear on whatever other day Guillemard finds convenient.
