Documents concerning the petition of Gabriel Arseno for a
dispensation from the diriment impediment in the second degree,
equal, of consanguinity with Catalina Leboeuf.

1) Gabriel Arseno from the parish of San Carlos de Alemanes
notifies the Bishop that he desires to marry Catalina Leboeuf from
the parish San Juan de los Alemanes, but that he could not do so
because of the diriment impediment of consanguinity that exists
between them. He asks the Bishop to order this information to be
accepted about the following points:
2) Gabriel Arseno set forth this relationship as follows:
a.) That Gabriel Arseno is the legitimate son of Miguel
Arseno and Mariana Andree.
b.) That Catalina Leboeuf, his intended wife, if the
legitimate daughter of Pedro Francisco Leboeuf and Magdalena Himel.
c.) That Pedro Francisco Leboeuf, father of his intended
wife, is the legitimate son of Pedro Leboeuf and Mariana Chelat.
d.) That Mariana Andree, his mother, is the legitimate
daughter of Juan Andree and Mariana Chelat, from which results the
impediment of consanguinity in the second degrees equal.
e.) That almost all the Acadian inhabitants of Caabanore are
relatives so that it is difficult to marry strangers. Furthermore,
Arseno specifies that his intended wife is poor and that if their
marriage does not take place, she would with her mother be exposed
to other ends.
3) That since these facts are considered sufficient, Gabriel
Arseno begs the Bishop to grant them this dispensation and that the
pastor of Caabanore may marry them in the usual form.
--To this is added a note dated Dec. 23, 1795 by Rivas as to the
copy of the first page, certifying that the above copy was
presented to him by Gabriel Arseno who could not sign.
--To this is added the decree of Bishop Penalver y Cardenas
ordering that the information presented by the party be received
and that the witnesses should appear and the results brought in.
Signed by the Bishop.
--To this is added a note by Rivas certifying that the above decree
was issued and signed by Bishop Penalver on Dec. 23, 1795.
--Another note is added by Rivas certifying that, on the same day,
he notified Gabriel Arseno of the above decree.

Rivas certifies:
1) That Gabriel Arseno appeared before him, and, under oath
answered the questions asked as follows:
2) a.) That his name is Gabriel Arseno from the parish of San
Carlos de los Alemanes; b.) That he is the legitimate son of
Miguel Arseno and Mariana Andree; c.) That he is 22 years old,
unmarried and engaged only to Catalina Leboeuf from the parish of
San Juan Bantista de los Alemanes; d.) That he knows of no other
impediment.
3) Finally Gabriel Arseno swears that all he said is the truth.
He did not sign the document because he could not. Notorised by
Rivas.
--Immediately appeared Joseph Godait, a witness presented by
Gabriel Arseno, who, under oath, testified as follows: a.) That
he knows Gabriel Arseno, legitimate son of Miguel Arseno and
Mariana Andree. b.) That Catalina Leboeuf is the legitimate
daughter of Pedro Francisco Leboeuf and Magdalena Himel. c.) That
the father of Catalina is the legitimate son of Pedro Leboeuf and
Mariana Chelat. d.) That the mother of Gabriel is the legitimate
daughter of Juan Andree and Mariana Chelat, from which results the
diriment impediment of consanguinity in the second degree, equal.
e.) That almost all the Acadian inhabitants of this parish are
relatives and that Catalina is orphan of father and very poor. f.)
Finally, he swears to the truth of his statements and that he is 52
years old.

--Immediately appeared Renato Arnan, another witness presented by
Gabriel Arseno, from whom Rivas received sworn testimony to the
truth of the same points witnessed by Joseph Godait. He swore also
that he is 34 years old and signed the document. Rene Arnan,

Penalver y Cardenas, Luis Bishop
(New Orleans)
The Bishop decrees:
1) That having examined these documents concerning Gabriel
Arseno's petition for a dispensation to marry Catalina Leboeuf, he
dispenses them from the impediment of consanguinity and considers
as legitimate any children they may have.
2) Moreover, that the parties must cease living under the same
roof for the present time, so they may restore with their example
all they have destroyed by their scandal.
3) Moreover, in order to absolve them from their fault, that
during the publication of the banns, they must pray daily on knees
the three parts of the rosary for two months and attend daily the
high Mass with a candle in the hand.
4) Furthermore, to this end, that a decree be sent to the pastor
of Caabanore so that he may dispense them from the publication of
the banns.

--To this is added a note by Rivas, on Dec. 24, 1795, certifying
that he notified Gabriel Arseno of the above decree.
--To this is added a note by Rivas certifying that the decree was
sent to the pastor of Caabanore, Patricio Mangan.
