Henriquez, Advocate of the Royal Court of Mexico and San Domingo, Auxiliary Vicar-General to the see of Havana and its jurisdiction, and Vicar Forane, Ecclesiastical Judge of the Province of Louisiana, appointed by Bishop Felipe Jose(ph) de Tres Palacios, appeared (and testified that) Olot, to carry out Cirilo's order, had turned over the goods of Sedella and Xerez. (62 items are listed for Xerez, including receipts, letters, books, etc., and a slave named Babin and her four children. 111 items are listed for Sedella, including affidavits, letters, a map, receipts, petitions, etc. and a testimony concerning an ecclesiastic whose name is withheld). Henriquez's signature is copied as "Enrriquez"; Quinones certifies as a notary public and adds in notes following that copies were made of this inventory and sent to the Auxiliary on January 31 and that Henriquez ordered that there be included in this inventory a negress named Mary and her two sons, slaves belonging to Father Xerez.

Instruction to the vicars, pastors and other ecclesiastics engaged in the care of souls in the province of Louisiana. East and West florida as also the governors and magistrates in as far as it concerns them concerning the marriages of English and Anglo- Americans and other Protestant aliens living in the aforementioned provinces. By the treaty of 1783 English and Anglo-Americans were to evacuate their possessions from the posts conquered by the arms of Spain. But in order not to inconvenience these people and in order that converts might be made to the Catholic Church these people have been allowed to remain if they submitted to certain conditions. Irish priests have been obtained to catechize and attract the colonists, their children and their households to the Catholic Church. (Then follow six) articles, the second of which states that when Protestants or a Protestant and a Catholic resident in the colony are to be married the ceremony is to be performed before the Catholic pastor and two or three witnesses; marriages before Protestant alien ministers or magistrates are invalid and the contracting parties are subject to confiscation of goods and exile. of Le Dru's letter of (June) 12. The diocesan (Felipe Joseph de
Tres-Palacios, bishop of Havana) instructed Henriquez' predecessor
(Father Joachim de Portillo, O.M.Cap.) that he could not name the
abbot Gace (Father Francisco de Gace) pastor of St. Charles
(Missouri) for the king does not permit any but Capuchin priests
in these provinces. However, great benefit has come already from
the appointment of Didier, therefore, using his plenary faculties,
Henriquez will under separate cover give Le Dru authority to
proceed in the matter and he will also send the same notice to
Father Paul of St. Peter, pastor of St. Genevieve, (Missouri).
He encloses a copy of the legal requisites in order to help
Carondolet decide what is to be done about the emigrant
parishioners.

Decree:
Interpreting the King's will and supposing on the assertion of
Le Dru that Dom Didier has the requisites prescribed by Trent and
the synodic councils of Havana he orders that Father Le Dru examine
the Benedictine before two witnesses to determine his ability and
learning. If the results are satisfactory Father Didier is to be
allowed to act as pastor of his immigrant parishioners, but he is
nevertheless suspended from exercising his ministry among others as
he has been doing. Father Gibault is to be examined by Father Paul
of St. Peter in the same manner as Father Didier.

His majesty approved and assigned to each a salary, allowing Father Didier to go to St. Ferdinand and St. Charles and Father Gibault to New Madrid.

He knows too that Father Didier came to this country to escape the fury of the populace who persecuted him for having obeyed the orders of the king and that he was chosen by the French immigrants to be their pastor. Lastly, he certifies that Father Didier stopped in 1792 at Fort Duquesne, Pennsylvania, on his return from Baltimore where he had gone to receive his faculties from Bishop (John) Carroll. He has been exact in his spiritual duties toward his flock as well as assisting them by his thorough knowledge of the theory and practice of medicine and surgery. On July 16, 1792 he sent to Father Le Dru original documents empowering him to receive information concerning the fitness of Father Didier who asked permission to be admitted to the territory of Illinois to administer to his emigrant parishioners Father Le Dru has, despite the long time which has elapsed, returned no answer. Zenon Trudeau in his letter of March 28 last to Carondolet states that Le Dru wished to return to Canada. In this case the people of those settlements would be left with only the priest of St. Genevieve (Missouri) which fact will increase the alarm felt by the people of St. Ferdinand and St. Charles on account of Father Didier being forbidden to exercise the functions he had been exercising before the resolution of his majesty. However, in consideration of the decision of the council presided over by the king on January 25 last and of the certification of Mr. Dehault, Henriquez grants him ordinary faculties but forbids the use of the pontifical faculties granted him until it is permitted by the diocesan whom he will inform in due time.

The Ursulines have been established in the Church for the training of youth in Christian piety according to the bulls of Paul V and Urban VIII. They receive not only boarders and orphans but also day students and all others who need instruction in religion. The constitutions ordain that they may receive students from the age of six to fifteen and if they are older than eighteen with the consent of the superior and the council. They do not admit any lady to the convent without permission of the superior as they have done (through Father Ubaldo Delgado) in the case of Miss Cadet. The diocesan bishop is the first superior of the Ursulines; the immediate superior is one chosen by secret ballot and approved by the bishop. To do away with day students in the time of epidemics or whenever other reasons justify it would be something new in the order. She mentions all this so that Henriquez may suspend the execution of his decree until they have the decision of the bishop of Havana to whom she will send the legalized copy left with her by Quinones.

Such formality is not necessary for leaving the convent save in the cases pointed out in the constitutions.
