1797 May 15 Penalver y Cardenas, Bishop Luis Proceedings against Father Pedro Gibaud, pastor of New Madrid, (Missouri).

Penalver y Cardenas, Bishop Luis Penalver having received reliable information against Pedro Gibaud and his immoderate use of liquor, had arranged, by a letter of August 28, 1796 for his Vicar-General in the Illinois country, Father James Maxwell) Diego Maxcibel to admonish him in a visit to this parish. The complaints having been repeated, Penalver ordered Maxcibel by a letter of September 15 to start an investigation. The opinion is that Gibaud also uses liquor before he celebrates Mass and sometimes does not celebrate Mass on feast days because his head is muddled, neither does he explain doctrine, as Father Junispero Berthiaume, O.F.M., and Juan Peltiel, who have just arrived from there, and others can tell. Quintero, Father Isidro Berthiaume appeared and testified that he had just come from New Madrid where he had lived in the house of the pastor, Father Pedro Gievaud from December 2 to January 8, that he drank frequently, being almost always drunk so that he sometimes could not say Mass on feast days. Sometimes he took a drink of brandy and then celebrated Mass, but that may have been to rinse his mouth, that Berthiaume never saw him preach nor teach catechism, that Berthiaume pointed out to him that he could die suddenly to which (Gibault) replied that he had already made his will. Quintero, Father Isidro Juan Peltiel, native of France of the city of Pont, swore that he was in New Madrid at the end of last year and the beginning of this year, living more than a month in the house of Father Pedro Gibaud who was almost always drunk, that he continually drank brandy, sometimes even before saying Mass and that even on feast days he could not say Mass because of his indisposition, that he never saw him preach, that his stomach is almost ruined so that he cannot eat. Laforge, Pedro Antonio With the permission of the Commandant, Carlos Dehault Delassas, there appeared before Maxwel(l), Ecclesiastical Judge of the District of the Illinois, and Laforge, notary, the following witnesses: Jose Joachim, Vadeboncoeur, Gascon, Noel Berthioume and Marcheaterre, called by the order of the Commandant to give testimony on the conduct of Gibault. Laforge, Pedro Antonio The one called Vadeboncoeur appeared and swore that his name was Pedro Gascot, a laborer, that he had known Gibault for about 5 years, had lived in the place three years, that he frequently visited at the pastor's house, that he had never seen Gibault unable to exercise his ministry, that he had never understood that Gibault had failed to visit the sick because he was drunk. Laforge, Pedro Antonio The one called Gascon appeared and swore that his name was Juan Viot, a laborer, that he had known Gibault for three years, had lived in the place two years, that he did not know whether Gibault drank immoderately until drunk; that he went to the pastor's house only when necessary; that he had no knowledge that anyone had died without the Sacraments through the fault of the pastor. Laforge, Pedro Antonio Noel Berthiaume, a silversmith, appeared and swore that he had lived in the place somewhat more than a year, that he went to the pastor's house occasionally, that he had never seen him drunk, but had seen him exhilarated some times from taking more drinks than he should have, that he had no knowledge that he had neglected to visit the sick in danger of death because of being drunk.
