Documents concerning the petition of Joseph Donato Landry
for a dispensation from the diriment impediment in the third
degree, equal, of consanguinity with Angela Landry.

(1) Joseph Donato Landry of the parish of St. Gabriel of Manchac,
Louisiana, notifies the Bishop that he desires to marry Angela
Landry of the parish of Ascension of La Fourche, but that he is
prevented by the diriment impediment of consanguinity that exists
between them. He asks the Bishop information about the following
matters.
(2) Joseph Donato Landry set forth this relationship as follows:
(a) Firstly that Joseph Donato Landry of the parish of St.
Gabriel of Manchac is the legitimate son of Jose Landry and
Margarite Leblanc. (b) Angela Landry, his intended wife, of the
mentioned parish is the legitimate daughter of Carlos Landry and
Mary Baben. (c) Jose Landry, his father, is the legitimate son of
Pedro Landry and Mary Baben. (d) Carlos Landry, father of his
intended wife, is the legitimate son of Francisco Landry and Dorada
Buchete. (e) Pedro and Francisco Landry their paternal grand
parents are the legitimate children of Pedro Landry and Margarite
Baben, from which results the impediment of consanguinity in the
third degree, equal. (f) In the post of La Fourche almost all the
Acadean families are relatives so that it is difficult to marry
strangers. Joseph Landry specifies too that his intended and he
are poor and if their marriage does not take place, she would be
exposed to other trials.
(3) Since these facts are considered sufficient, Joseph Donato
Landry begs the Bishop to grant them this dispensation and that the
pastor of the above mentioned parish be permitted to marry them in
the usual form.
--To this document is added the decree of the Bishop Luis Penalver
y Cardenas that the information presented by Joseph Donato Landry
be received and that his witnesses should appear before the
present secretary. After all is done, the declarations must be
brought in. Signed by the Bishop.
--To this is added a certification by Joseph Maria Rivas,
secretary, that the Bishop ordered the decree and signed it on Aug.
11, 1795.
--The document is signed on Aug. 11, 1795 by the secretary Rivas at
the request of Joseph Donato Landry who could not write (This note
is added at the top of the first page of the document).

Rivas certifies:
(1) That in virtue of the commission granted him by the decree of
Bishop Penalver y Cardenas, Joseph Donato Landry appeared before
him, and under oath, answered the questions asked by Rivas as
follows:
(2) That his name is Joseph Donato Landry native of the parish of
St. Gabriel of Manchak and that he is the legitimate son of Jose
Landry and Margarite Leblanc; aged 18 years, unmarried and engaged
to Angela Landry native of the parish of Ascension of la Fourche.
Both are neighbours in la Fourche. Moreover, Joseph Landry said
that he knows of no other impediment. Finally, he swears that all
he said is the truth, and did not sign because he could not write;
this is notarized by Joseph Maria Rivas, Secretary.

Rivas certifies that in virtue of his commission, he received
the following information, under oath, from Carlos Goden from New
Orleans, a witness presented by Joseph Donato Landry on the same
day, month and year. (a) Goden knows that Joseph Landry is the
legitimate son of Jose Landry and Margerite Leblanc. (b) That
Angela Landry if the legitimate daughter of Carlos Landry and Maria
Baben. (c) That Jose Landry is the legitimate son of Pedro Landry
and Maria Baben. (d) That Carlos Landry is the legitimate son of
Francisco Landry and Donada Burchete. (e) That since Pedro and
Francisco, Landry paternal grandparents of the parties, are the
legitimate children of Pedro Landry and Margerite Baben, they are
bound by the relationship of consanguinity in the third degree,
equal. (f) That these facts are publicly known in La Fourche.
Finally, Carlos Goden swears it the truth of his statements and
that his age is 48 years. He did not sign because he could not
write. This is notarized by Joseph Maria Rivas, Secretary.
--To this is added a certification by the Secretary Joseph Maria
Rivas (at the top of the first page of the document) in which he
says that on another day he notified Joseph Donato Landry of the
above decree.

Rivas certifies also that immediately Joseph Donato Landry
introduced another witness Joseph Landry, from whom Rivas
received sworn testimony to the truth of the same points witnessed
by Carlos Goden. He swore also that he was 35 years old, and
signed the document Joseph Landry. This is notarized by Joseph
Maria Rivas, Secretary.

The Bishop decrees:
(1) That having examined these documents concerning Joseph Donato
Landry's petition for a dispensation to marry Angela Landry, he
dispenses them from the impediment of consanguinity and considers
as legitimate any children they may have.
(2) Moreover he ordains that the parties must cease living under
the same roof for the present so that they may restore with their
example all they have destroyed by their scandal.
(3) Moreover, in order to absolve them from their fault, the
Bishop ordains that during the publication of the banns they must
daily pray on their knees the three parts of the rosary and
contribute twenty pesos of alms to their parish.
(4) Furthermore to this end, the Bishop ordains that the decree be
sent to Father Bernardo Pastor of la Fourche, so that the latter
may dispense them from the publication of the banns. Signed by the
Bishop and witnessed by Joseph Maria Rivas.
--To this document is added a note by Rivas certifying that at New
Orleans on another day he notified Joseph Donato Landry of the
above decree.
--Finally another note is added by Rivas that the decree of the
Bishop was sent to the pastor Father Bernardo de Deba of la
Fourche.
