Samuel offers to live with his intended wife and children according to the Catholic religion; this is one of the necessary circumstances but there must also be grave and almost always public cause according to the expression of Pope Benedict XIV in his diocesan synod. Since this does not appear it seems that the petition cannot be granted.

Concerning the free or slave state of infants baptized, they can rely only on the word of those assisting at the baptism. Since the entry is more than 2 yerfs old, it is almost impossible to remember why he recorded the child as free. He corroborates the good faith with which they proceed not only with this sacrament but in making the entries. for instance, in the burial register on January 2, he recorded as a charity case, Urel Dupre, a native of Nantes, assured that he had died suddenly in the home of Mr. Saulet and in dire poverty. The truth of the case was that Urel did not die suddenly but made a will, nor in poverty, as he ;eft ,pre tjam 2.000 pesos. It is easy to be deceived.

In a letter of September 15, 1795, the Council of the Metropolitan Church of Guatemala informed the king that the treasury had sent back the record of the fabrica for 1781 in which they repaid 1850 pesos, 2 reales, 11 maravedis they had credited to their account for expenses at the welcoming of their prelate (Archbishop) Cayetano Francos (y) de Monroy on pretext of the poverty of the church and lack of other means. Law 18 and the royal patents of May 23, 1779 and July 23, 1796 forbid the crediting of such expenses. In the future such expenses are to be paid from the revenues of their respective churches. In his royal order of October 29, 1799, Charles sent to the Council of the Indies, a copy of the Brief of His Holiness given at Grenoble July 7 in which the Holy Father authorized him to collect 20 million reales to meet the expenses of the war in the same terms as the former one of January 7, 1795 which was communicated by the royal order ofc December 9, 1799, and which his Council lost no time in fulfilling. The import of the July 7 brief is the following: (The text of the letter in Latin and Spanish) of Pius VI, signed by Joseph Maroti, Secretary. Leandro Fernandez de Moratin certifies the above translation at Madrid on October 26, 1799 and Matias de Mur y de los Rios states that it was registered. (A statement is given of) the amounts of capital and levy of the Indies and Philippines (including) Louisiana, made up in the royal treasury according to the decree of December 9 is given by Pedro Aparici and (?) The Count of Casa Valencia. The king wishes each one to follow his royal order as becomes them. Aparici adds that it was registered in the Northern Department of the General treasury of the Indies on March 3, 1800.

Antonio Cornel sent Sentmanat the following order of the king in a letter dated February 20: The king has ordered put into execution the sentence imposed by the Deputy in Military Affairs del Ferrol on Sergeant Juan Martinez of the American army of six months' suspension for his clandestine marriage to Juana Galvez, as provided in the royal orders of March 19, 1775 and October 31. It is His Majesty's wish that the above decision be circulated to the army and navy of Spain and the Indies. Cornel sends this as an answer to Sentmanat's letter of October 4, 1799. Sentmanat sends it to Penalver for his use in all such cases.

In his royal order of September 16, 1799 the king sent to the Council
of the Indies, copies of his decrees of September 5 and 6 with the
following content: On August 9 Pius VI died and in these turbulent
times in Europe the election of a successor may not be prompt,
therefore until he notifies them of the election of a new Pope, the
Archbishops and Bishops will use their faculties to the full,
conformable to the discipline of the Church, for marriage
dispensations, etc., and the Tribunal of the Inquisition and the Rota
will continue their functions. Joseph Antonio Caballero's
letter of September 5, 1799, from San Ildefonso, to the Bishops cited
the king's decree which ruled that the announcement of the pope's death
was to be announced only in the terms of the Gazette and in order not
to disturb the king's subjects he exhorts all to act as His Majesty
would desire. Caballero's letter of September 6, 1799, urges religious
institutes to do nothing to disturb the consciences of the king's
subjects. The king urges all Archbishops and Bishops and Superiors of
Orders to carry out his decrees.

Father Juan Pimentel, pastor of Piedras, resigned his benefice because of ill health and went to the country. The following order was sent out: "These proceedings are to be given to the Vicar General so that they may be concluded in respect to the grave illness which caused the withdrawal." As Vicar General, Andino advised the Governor and the synod of the vacancy and recommended the appointment of Father Miguel Feliciano, canon of the Cathedral, in the name of the king. But the governor replied that Andino had no right to appoint himself the purveyor of curacies. He hopes that Penalver will tell him what the practice is in his tribunal.

Andino will note that in the competition for parishes with the see filled, they have a royal assistant, a practice not observed in Havana and not in the vacancies cited in Law 37 of Book One, but in that diocese they have a particular arrangement.

Penalver received Andino's letter of November 29, 1798 in which he acknowledges receipt of Penalver's of October 23, (1797) telling of his desire to be with Penalver and that he was now vicar general of Puerto Rico. This diocese is different from all others in Spain; all the ecclesiastics whether pastors or assistants are salaried by the king at 40 pesos a month; there are no chaplaincies and were it not for a pious Spaniard who built the Cathedral and a hospital and improved the convent, these would be a plan only. Penalver's two canons get only 600 pesos a year. The bishop gets 4000 divided among five bishropics; he would not be able to live without his patrimony. The upkeep of his house and his visitations are costly. Penalver's heart is afflicted by the different sects which grow through tolerance and multiply the evils.

The contents of Penalver's letter of June 20, 1798 has confirmed public opinion in this city concerning Penalver's talents. Owing to the continuous griefs which encompass this prelate, arising from the rivalries, above cited, with the governor and superior general of the Franciscans and all the priests and other individuals of the city and island, which Andino has not been able to help because he is not in contact with the bishop who is making his pastoral visit in the interior, it is certain that the proceedings for his transfer will not be difficult because of the influence of two brothers, inhabitants of the town and shortly(?) from Madrid. Andino takes the liberty of telling this because of his desire to be in that diocese which will experience the generosity of Penalver's rule. In addition to the sure income of 4000 pesos there is an annual income of 18 to 20 thousand from fees according to the established fees since the term of Bishop Manuel Ximenez Perez, and other income. Andino will not lose the hope of the happiness of this country with the coming of Penalver.

Father Gregorio White, a native of Ireland, came to this province by a royal order of April 5, 1786, chosen by the Bishop of Salamanca to serve parishes in his own language, which he did in various places until for reasons of health he obtained a royal permit on October 24, 1799 to retire to Bilboa. Due to go through this city to Havana, White has asked for letters of recommendation. Letters are to be dispatched and Penalver attests that White is not excommunicated, irregular, or suspended. Father Isidro Quintero acts as secretary.
